Notice regarding the right of withdrawal pursuant to Art. 52 of the Italian Consumer Code

Withdrawal

Without prejudice to the exclusions under Section VII below, the Consumer Customer has the right to withdraw from the contract for any reason, without having to provide explanations and without any penalty (the “Right of Withdrawal” or “Withdrawal”).

Withdrawal may concern all or only some of the Products purchased by the Consumer Customer.

The Right of Withdrawal may be exercised within 14 days from the date on which the Consumer Customer, or a third party appointed by the Consumer Customer, has received the Products. Where multiple Products are ordered in a single order and delivered separately, the 14-day period starts from the date on which the Consumer Customer, or a third party appointed by the Consumer Customer, receives the last Product.

To exercise the Right of Withdrawal, the Consumer Customer must send the Seller, within the above term, a communication containing the data indicated in the withdrawal form available here, or any other explicit statement of the decision to withdraw.

Such communication may be sent by e-mail or registered letter with return receipt (A/R), addressed to:

Once the Withdrawal notice has been received, the Seller’s customer service will e-mail the Consumer Customer the case number and the instructions for returning the Products.

The Right of Withdrawal is subject to the following conditions:

I. The Right of Withdrawal applies to the Product purchased in its entirety; therefore, where the Product consists of multiple components or parts, it is not possible to exercise Withdrawal only in relation to part of the Product.

II. If the Right of Withdrawal is exercised in time, the Seller will reimburse the Consumer Customer all payments received in relation to the Products subject to Withdrawal (the “Returned Products”), including standard delivery charges, within 14 days from the date the Seller receives the Withdrawal notice. The Seller is not required to reimburse any supplementary delivery costs resulting from the Consumer Customer’s choice of a delivery method other than the least expensive standard delivery method offered by the Seller. The Seller may withhold the refund until it has received the Returned Products or until the Consumer Customer provides evidence of having shipped them, whichever occurs first.

III. The refund will be made using the same means of payment used by the Consumer Customer, unless the Consumer Customer has expressly agreed to a different method, provided that the Consumer Customer does not incur any fees as a result of the refund.

IV. The Consumer Customer who has communicated Withdrawal within the term and in the manner indicated above must return the Returned Products to the Seller no later than 14 days from sending the Withdrawal notice.

V. The direct costs necessary to return the Returned Products shall be borne by the Consumer Customer, unless the Seller has expressly agreed to bear such costs; the return shipment is under the responsibility of the Consumer Customer until the Products are received by the Seller.

VI. Products should be returned in the condition in which they were received, with their original tags, labels, packaging, accessories and documentation where applicable. The Consumer Customer is responsible only for any diminished value of the Products resulting from handling other than what is necessary to establish their nature, characteristics and functioning. Any such diminished value may be deducted from the refund.

VII. The Right of Withdrawal does not apply to Professional Customers. For Consumer Customers, the Right of Withdrawal is excluded in the following cases pursuant to Art. 59 of the Italian Consumer Code, as amended:

  • Made-to-measure or clearly personalized products, including products manufactured or customized according to the Customer’s specifications (e.g., tailored items, monogrammed or altered garments, Private Label products with logo application, custom labels or tags, custom packaging, or other customer-specific customization).
  • Sealed goods not suitable to be returned for reasons of health protection or hygiene that have been unsealed after delivery (e.g., underwear, hosiery, or swimwear without an intact hygiene seal).

Refund

ItalyNext Srl’s customer service will acknowledge your communication by providing a case number and return instructions. You must ship the Returned Products within 14 days from the date on which you informed ItalyNext Srl of your decision to withdraw, in accordance with the conditions set out above.

ItalyNext Srl will refund all payments received in relation to the Returned Products, including standard delivery charges and any applicable taxes, within 14 days from the day it was informed of the decision to withdraw. Any supplementary delivery costs resulting from your choice of a delivery method other than the least expensive standard delivery method offered by ItalyNext Srl will not be refunded. ItalyNext Srl may withhold the refund until it has received the Returned Products or until you have supplied evidence of having sent them back, whichever occurs first.

The direct costs for returning the Products shall remain at your expense, unless ItalyNext Srl has expressly agreed to bear such costs.

The refund by ItalyNext Srl will be made using the same payment method used for the original transaction, unless you expressly agree to a different method, provided that you do not incur any fees as a result of the refund. Nothing in this policy limits any mandatory rights granted to Consumer Customers under applicable consumer-protection law.
