1. Introduction and effectiveness of the General Terms of Sale.
These general terms of sale (“General Terms”) govern distance purchases of products (“Product” or “Products”) via the website https://viamadeinitaly.com (the “Site”).
The seller of the Products and owner of the Site is ItalyNext Srl, with registered office at Piazza Giacomo Zanellato 23, 35131 Padova (PD), Italy, VAT IT05133660281 (the “Seller”).
The person accessing the Site to purchase Products (the “Customer”) must, before submitting the order, carefully read these General Terms, which are published on the Site and may be consulted at any time, including through the link contained in each order-confirmation email, so as to allow reproduction and storage.
If the Customer purchasing through the Site is a “professional” as defined by Article 3(1)(c) of Italian Legislative Decree 206/2005, as amended (respectively, the “Professional Customer” and the “Consumer Code”), neither the withdrawal rules under Section 6 of these General Terms nor, more generally, provisions applicable solely to the so-called “consumer” as defined by Article 3(1)(a) of the Consumer Code (the “Consumer Customer”) shall apply.
The languages available for purchasing Products on the Site are Italian and English. In case of discrepancy, the Italian version prevails for Customers in Italy.
2. Selecting and ordering Products
The features, price and labeling of each Product are shown on the relevant product page. The graphic representation corresponds to the photographic image accompanying the description. Images are for presentation purposes only and may not be perfectly representative of characteristics (e.g., color tone may vary due to screen settings).
To purchase Products, each new Customer must register on the Site and accept the General Terms. Registered Customers may purchase by entering their credentials (username and password) in the “Registered Customers” section. The Customer must then complete and submit the electronic order form, selecting the chosen payment method.
The contract between the Seller and the Customer is concluded only upon the Seller’s express acceptance of the order. Such acceptance is communicated via an order-confirmation email containing: a link to these General Terms, the order number, shipping and billing data, the list of Products ordered with their essential features, and the total price including delivery charges and any ancillary costs.
Once the order is received, the Seller will verify Product availability. If one or more Products are unavailable, the Seller’s customer service will inform the Customer by email, who will have 48 hours to confirm or cancel the purchase. If no response is received within that term, the order will be considered cancelled.
MOQs and multi-supplier baskets. Minimum order quantities may apply at item level and/or at supplier (brand) level. The cart automatically checks these thresholds—even when mixing brands—and shows any shortfall. The Customer must adjust quantities/items to meet the minimums or contact us for assistance in optimizing the basket.
3. Prices and delivery charges
Product prices are expressed in Euro and include VAT where applicable.
Delivery charges and any additional costs not included in the price (e.g., customs duties, clearance) are borne by the Customer and will be clearly indicated before the Customer submits the purchase order (“Ancillary Charges”).
Shipping quotes for consolidated orders. For international and multi-supplier orders, shipping is calculated case-by-case based on weight/volume, packaging, destination and the number of suppliers fulfilling the cart. At checkout you may pay a deposit (see Section 4.2); we will then consolidate your order and communicate the exact shipping quote before the balance is due.
4. Payment methods and invoicing
4.1 Payment methods
The Customer may pay for Products and Ancillary Charges by credit/debit card, PayPal, bank transfer, or prepaid cards.

Cards accepted on the Site include:

Security. The payment transaction is processed on the provider’s secure servers. The Site does not store card numbers. Using encrypted communication (SSL/TLS), returning Customers may opt to save a tokenized payment method with the provider to streamline future purchases.
PayPal
After placing the order, the Customer will be redirected to PayPal to pay via PayPal account or card, in accordance with PayPal’s terms.
Bank transfer
The Customer must make the transfer within the 3rd day following the order-confirmation email sent by the Seller. Otherwise, the order will be cancelled.

Cash on delivery (currently unavailable)
This method is currently unavailable.
4.2 Deposits and balance payments
Unless otherwise stated, checkout may require a 10% deposit to reserve items and start processing (including consolidating multi-supplier orders and confirming lead times/customizations). The balance (including the final shipping cost communicated to you) is due when the order is ready to ship or as otherwise indicated in the order update. The deposit is fully credited toward the order total and is refundable if the order is not accepted or cannot be fulfilled. For Consumer Customers, statutory withdrawal rules apply. For Professional Customers, deposits for made-to-order or customized items may become non-refundable once production starts, to cover incurred costs.
Invoicing
If the purchase is made by a Professional Customer, an invoice may be requested by selecting the appropriate option during checkout and entering complete billing details, including tax code and/or VAT number. The invoice will be emailed to the address provided. The Professional Customer is responsible for correct data entry and is informed that if the invoice is not requested during checkout, it cannot be requested later.
Shipping and delivery
Products are delivered to the address provided by the Customer during purchase in the “Shipping Details” field.
All Products are delivered by express courier; the Seller is not liable for delays that are unforeseeable or not attributable to it. When Products are shipped, the Customer receives a confirmation email including a tracking link. Unless otherwise communicated (e.g., for made-to-order items), Products are typically delivered within 7 business days from the day after the Seller confirms dispatch. Countries currently served are those enabled at checkout and may change over time.
Right of withdrawal
Without prejudice to the exclusions under point VII below, the Consumer Customer has the right to withdraw from the contract for any reason, without having to provide explanations and without any penalty (“Right of Withdrawal” or “Withdrawal”).
Withdrawal may concern all or only part of the Products purchased by the Consumer Customer.
The Right of Withdrawal may be exercised within 14 days from the date on which the Consumer Customer, or a third party appointed by the Consumer Customer, has received the Products.
To exercise the Right of Withdrawal, the Consumer Customer must send the Seller, within the above term, a communication containing the data indicated in the withdrawal form available here, or any other explicit statement of the decision to withdraw.

Once the Withdrawal notice has been received, the Seller’s customer service will email the Consumer Customer the case number and instructions for returning the Products.
The Right of Withdrawal is subject to the following conditions:
I. The Right of Withdrawal applies to the Product purchased in its entirety; where the Product consists of multiple components or parts, it is not possible to exercise Withdrawal only in relation to part of the Product.
II. If the Right of Withdrawal is exercised in time, the Seller will reimburse the Consumer Customer the full price of the Products (including any standard delivery charges) subject to Withdrawal (the “Returned Products”) within 14 days from the date the Seller receives the Withdrawal notice. The Seller may withhold the refund until it has received the Returned Products or until the Consumer Customer provides evidence of having shipped them, whichever occurs first.
III. The refund will be made using the same means of payment used by the Consumer Customer, unless the Consumer Customer expressly requests a different method, provided it is not more costly for the Seller.
IV. The Consumer Customer who has communicated Withdrawal within the term and manner indicated above must return the Returned Products to the Seller no later than 14 days from sending the Withdrawal notice.
V. All costs necessary to return the Returned Products are borne by the Consumer Customer; the return shipment is under the sole responsibility of the Consumer Customer.
VI. Products must be returned unused, unwashed, in normal condition, with all original tags and labels attached, placed in the original packaging and complete with all parts and any accessories and documentation (e.g., garment bag, hangtag, authenticity cards). Handling should be limited to what is necessary to establish the nature, characteristics and functioning of the goods; any diminished value due to improper handling may be deducted from the refund.
VII. The Right of Withdrawal is excluded, in addition to sales to Professional Customers, in the following cases pursuant to Article 59 of Legislative Decree 21/2014, as amended:
- Made-to-measure or clearly personalized products (e.g., tailored items, monogrammed or altered garments).
- Sealed goods not suitable to be returned for reasons of health protection or hygiene that have been unsealed after delivery (e.g., underwear, hosiery, or swimwear without an intact hygiene seal).
6. Authenticity, origin and supplier verification
All VIAMADEINITALY partners are Italian producers and “Made in Italy” certified. The Seller verifies documentation, materials and craftsmanship on site, maintains full traceability, and curates only authentic collections. Where helpful, the Seller can connect Customers directly with manufacturers for technical details, samples or bespoke work. Ongoing quality audits are in place.
7. Legal Warranties
Legal warranty for Consumer Customers: Consumer Customers are entitled to the legal warranty under Articles 128–132 of the Consumer Code. Defects of conformity must be reported to the Seller within 2 months of discovery. The warranty covers defects appearing within 2 years from delivery of the Product.
Legal warranty for Professional Customers: Professional Customers are entitled to the warranty under the Italian Civil Code, which must be exercised within 8 days of discovering the defect and remains valid for 12 months from delivery of the Product.
8. Errors and limitation of liability
Product information is constantly updated, but the absence of errors cannot be guaranteed. The Seller reserves the right to correct any errors or omissions even after an order is confirmed. The Customer shall not be entitled to compensation for non-acceptance or non-fulfilment of an order.
9. Complaints

10. Governing law and jurisdiction
The sales contract is governed by Italian law. For disputes, the competent court is that of the Consumer Customer’s place of residence or domicile in Italy; in all other cases, the competent court is Padova.
11. Personal data processing
Customer data are processed by ItalyNext Srl in compliance with applicable data-protection laws. For details, please refer to the Site’s Privacy Policy.

Pursuant to Article 1341 of the Italian Civil Code, the Customer expressly accepts the following clauses of these General Terms: 7 (Legal Warranties), 8 (Errors and limitation of liability), 10 (Governing law and jurisdiction).
